Comment évaluer une personne ?

Résumé

The psychiatric report is an assessment tool that has become essential in the judicial field while, at the same time, being regularly challenged. How can we understand this seeming paradox? In response, the article describes how the law formalizes part of the morality of the category of person. From a case study based on observation of how psychiatric reports are used in criminal courts, the first part shows judicial actors evaluating the assessment tool; the second part focuses on the construction, during a trial, of a deviant otherness, that of the sexual offender.
L'expertise psychiatrique est un instrument d'évaluation devenu indispensable dans le champ judiciaire tout en étant régulièrement contesté. Comment comprendre ce para- doxe apparent ? En décrivant, répond l'article, comment le droit formalise une partie de la morale autour de la catégorie de personne. À partir d'une étude de cas fondée sur une observation des usages de l'expertise dans une chambre correctionnelle, la première partie montre comment les acteurs de la justice évaluent l'instrument d'évaluation ; la seconde partie se penche sur la construction d'une altérité déviante, celle du délinquant sexuel.
